General terms and conditions

The present General Terms and Conditions (hereinafter referred to as the GTC), the information and associated rules on use refer to the innovetica. ch website and to the Apps Innovetica (hereinafter referred to collectively as “Innovetica”). They are managed by the legal entity listed in the imprint (hereinafter referred to as “operator”). The GTC govern the business relations between the users of Innovetica and the operator.

With your use of Innovetica, you accept the following terms and conditions without reservation and declare your agreement with them.

The terms and conditions, the information as well as the rules of use can change at any time. The changes are binding.

Innovetica excludes as far as legally permissible any liability (including slight negligence and coincidence, ii), liability for consequential damage (e. g. loss of profit) as well as liability for auxiliary persons) and in connection with the use of the App. The same shall apply in the event of unlawful interference with data transmission or processing or the mobile radio device. Finally, Innovetica accepts no liability for the correct and complete use of Innovetica with devices where the manufacturer’s protective measures are reduced or disabled.

Innovetica reserves the right to change, redesign or remove individual information, rules or functions without prior notice. Innovetica can therefore not be held responsible for the consequences of such changes.

Innovetica does not guarantee that the website and the apps as well as the offered functionalities will always be used trouble-free and that the requested information can be transmitted smoothly and error-free.

Innovetica cannot guarantee that the information provided here is up to date, detailed and complete at all times.

Access to the Innovetica App is via download of the Innovetica App from the Apple App Store or the Google Play Store.

Your use is deemed to be your consent to the use of the transmitted data for further offers and information (newsletters and advertising) and to their transmission (by e-mail), storage and processing within Switzerland, the Principality of Liechtenstein, Germany and the USA. The passing on of your data to third parties is excluded, as long as the data are not passed on to the sponsor for the purpose of sending the prize in the event of a possible win. If you no longer wish to receive offers and information from Innovetica, you can revoke the use of your data at any time at info@innovetica.ch

Innovetica undertakes to exercise the necessary care in dealing with your personal data at all times and to observe the Swiss data protection regulations.

Contest

For simplicity’s sake, in these conditions only the term “competition” is used or, as a synonym, “Weekly Challenge”, “Innovetica Masters” or “Qualifier”. The terms and conditions also apply to lotteries, puzzles and raffles.

Entitled to participate in the competition is the person who is at least 17 years of age at the time of registration or registration and who is resident in Switzerland or the Principality of Liechtenstein.

Participation in the game and in the competition is via the Innovetica software application (app). To participate in this competition you need an Innovetica login. If you do not have such a login, you can register in the app. The general terms and conditions and data protection regulations apply. The following information is required for registration: player name, e-mail, password.

The use of the website and participation in the competition is only possible with correct personal data. Innovetica is entitled to exclude users and participants with a pseudonym, a fake identity and, in the case of the competition, participants with multiple registrations from the competition.

Innovetica has the right to exclude users and participants of the competition from the game and/or competition at its own discretion and without stating any reasons, in particular participants who display offensive, racist behaviour contrary to the imperative of fairness or otherwise offensive or non-compliant behaviour or who carry out technical manipulations or make an attempt to do so.

Only one entry per person per week is possible for the Weekly Challenges. Participation in the Weekly Challenge is done by clicking on the appropriate menu of the app. Contest clubs, automated services and other professional/commercial participants are excluded from participation.
Participation in the competition is free of charge and free of any obligation to purchase.

The competition starts on Sunday, 00:01 o’ clock. The closing date for the weekly competition is 23:59 on Saturday. Among all participants who meet the participation criteria communicated here and in the app, the following Tuesday the winners will be randomly drawn by lottery or the participants will be shown in the app vouchers in the form of barcodes. The winner of the random draw will be notified promptly by e-mail. For this purpose, the e-mail address will be passed on to the sponsor of the prize for the purpose of sending the prize. If the person contacted does not respond within 7 days, the prize will be forfeited.

By using or participating in the competition, participants agree that their personal details (concretely: player’s name, first name and first letter of last name) will be published in all communication channels of Innovetica and its sponsors, in particular on the website www.innovetica.ch, Facebook, Instagram and Twitter.

Legal recourse is excluded. No correspondence will be entered into about the competition except with the winners. Winnings will not be redeemed or exchanged in cash. Profit may be subject to income taxes. The prizes are not transferable. The winner accepts any changes to the prizes.

The usual costs for telecommunications services may apply when downloading and operating the app.

Innovetica is entitled to make adjustments to Innovetica and the competition mode at any time and to suspend, terminate or prematurely terminate the competition if there are important reasons for doing so. In the event of a cancellation, prizes will be awarded by lot to all registered participants.

The contest or sweepstake is not affiliated with Apple, Facebook, Instagram or Twitter and is neither sponsored, supported nor organized by these platforms. The organiser is the sole contact person and responsible for the event.

By registering, you acknowledge that this contest is not affiliated with Facebook and, in particular, that it is not sponsored, supported or organized by Facebook in any way. You hereby indemnify Facebook from any and all claims related to this contest. All information is provided by the contest organizer and not by Facebook, and you do not provide your information to Facebook under this contest, but to the contest organizer.

Apple is not a sponsor and is not involved in any way in any of Innovetica’s contests or sweepstakes. Innovetica does not use Apple products as prizes for its competitions or sweepstakes.

The registered data can be stored by Innovetica and used for its own information and marketing purposes. The data will not be passed on to third parties unless there is a legal obligation to do so.

In order to obtain error reports after a crash of the app, the HockeyApp error tool from Bit Stadium GmbH from Germany is used.

In order to redeem coupons or vouchers digitally, they must be activated via the Innovetica App. After activation, the digital coupons and vouchers are immediately ready for redemption and become invalid after the time indicated in the app.

In the case of limited prizes, coupons and vouchers, the delivery will only take place while stocks last.
